Terms and Conditions

  1. By accessing HomeConnectionsm, you are agreeing to be bound by these terms and conditions, all applicable laws and regulations, and any other applicable policies, terms and guidelines established by Colorado Housing and Finance Authority (CHFA). If you do not agree with any of these terms, do not use or access HomeConnection. CHFA may modify these terms and conditions from time to time without notice. Modification of these terms and conditions will not affect, or result in the termination or modification, of any other existing agreements you may have with CHFA. By using HomeConnection, you are agreeing to be bound by the then current version of these terms and conditions. Any modifications are effective as of the date posted.

  2. Consent. By using the services provided to you through HomeConnection, you consent to the collection and use of your information as outlined and to the limitations on our responsibilities to you. Further, by accessing HomeConnection, you affirmatively consent to CHFA emailing you and to receiving CHFA Home Finance eNews communications which generally provide information about CHFA single family mortgage loan programs, guideline updates, trainings, and CHFA events. You may opt out at any time, but in doing so, you may miss timely notifications related to CHFA Home Finance products and operations.

  3. Copyright. All information, documentation, and other content in HomeConnection is owned by CHFA. Without limiting the foregoing, all texts, graphics, images, marks, and logos in HomeConnection (collectively the “Materials”) are the property of CHFA. You may not sell or modify the Materials or display, externally distribute or otherwise use the Materials in any way or for any purpose other than as expressly provided. Nothing in HomeConnection should be construed as granting any license under any of CHFA’s intellectual property rights. CHFA prohibits use of the CHFA logo or any of the graphics or images contained in HomeConnection unless such use is pre-approved in writing by CHFA. All rights not specifically granted herein are reserved by CHFA.

  4. Disclaimer/No Warranties. The materials in HomeConnection are provided "as is." CHFA makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. The information and content provided is intended for informational purposes.

  5. Limitations/Indemnification. In no event shall CHFA or any of its directors, officers, employees, representatives or agents be liable for any damages whatsoever (including, without limitation, incidental and consequential damages, lost profits and/or other losses) arising out of the use or inability to use the Materials and/or HomeConnection, even if CHFA has been notified orally or in writing of the possibility of such damage. CHFA will not be responsible in any way for loss or damage that results from your failure to comply with these terms or other applicable guidelines, or from any technical, human or software errors or failures found in HomeConnection. You agree to defend, indemnify, and hold CHFA, its directors, officers, employees, representatives and agents harmless from and against any claims, actions, demands, suits, proceedings, losses, damages, costs, and expenses, including, without limitation, attorneys’ fees arising from or relating to your access and/or use of HomeConnection or the Materials.

  6. Links. HomeConnection may contain links to other websites. Links to external or third-party websites are provided solely for your convenience. The presence of a link does not imply any endorsement of the material on the website or any association with the website’s operators. You understand that when going to a third-party website, that site is governed by the third-party’s privacy policy and terms of use, and the third-party is solely responsible for the content and offerings presented on its website. CHFA makes no representation and accepts no responsibility or liability regarding the quality, safety, suitability, or reliability of any external website or the content or materials of such website. Use of linked sites is strictly at your own risk.

  7. Relationship. Your accessing HomeConnection in no way shall be deemed to create an agency or employee-employer relationship of any kind between you and CHFA, nor do these terms extend rights to any third-party. You also agree that in the course of your accessing and using HomeConnection, that no relationship is formed between you and CHFA that is either confidential or fiduciary in nature beyond any existing relationship you may have with us

  8. Compliance with Guide. Use of HomeConnection is available only to authorized users and must be in accordance with CHFA guidelines set forth in the Seller’s Guide found on the CHFA website.

  9. Consumer Privacy Laws. By using the services provided to you in HomeConnection, you affirmatively: (a) agree to comply with applicable consumer privacy laws (any and all federal, state and local statutes, regulations and rules applicable to the protection and privacy of consumer information, including but not limited to the privacy provisions of the Gramm-Leach-Bliley Act, 15 U.S.C Section 6801 et seq.), (b) agree to implement appropriate measures designed to safeguard consumer information, and (c) acknowledge your obligation to maintain the confidentiality of information governed by consumer privacy laws.

  10. Termination/Restrictions on Use. You agree that your use of HomeConnection may be immediately terminated in the event of a breach of any of these terms and conditions, as determined by CHFA in its sole discretion. Further, CHFA may, if deemed necessary in its sole discretion, impose restrictions, suspensions, limits, controls or deny you access to HomeConnection even in the absence of such breach. All such matters are solely within the discretion of CHFA and shall not give rise to any claims or rights against CHFA.

  11. Third Party Information. In some cases, you may be accessing and using HomeConnection for the purpose of communicating data about private individuals and other third parties in connection with loan transactions. You warrant that the third party who has provided such information to you has been advised: (a) that such information may be transmitted over the Internet, (b) the information may be processed and handled through this website, (c) of the potential risks involved, and (d) has consented to such transmission.

  12. Security Measures. HomeConnection has reasonable security measures in place to help protect against the loss, misuse, and alteration of any information under CHFA’s control.
